Conditions of Ijtihad

(1) He must be a master of the language of the Arabs, knowing its different dialects, the import of their  poems, their proverbs, and their customs. [30]  

(2) He must have a complete grasp of the differing opinions of the scholars and jurists of Islam.  [31] 

(3) He must be a jurist himself, learned in the Qur’an, having memorized it and knowing the difference of the seven readings of the Qur’an while understanding its commentary, being aware of what is clear and what is obscure in it, what it abrogates and what is abrogated by it, and the stories of the prophets.

(4) He must be learned in the Sunna of the Messenger of Allah, capable of distinguishing between its sound hadith and its weak hadith, its continuous hadith and hadith whose chain of transmission is broken, its chains of transmission, as well as those hadith which are well known. [32]

(5) He must be scrupulously pious in the religion, restraining his lower desires with respect to righteousness and trustworthiness, and his doctrine must be built upon the Qur’an and the Sunna of the Prophet. One who is missing in any of these characteristics falls short and is not permitted to be a Mujtahid whom people imitate. [33]

Kissing and touching graves

Though permissible according to some scholars, Imam Ahmed Rada disliked the practice in his Fatawa, in accordance with the soundest position.

He states: “there are diverse opinions amongst the scholars regarding kissing graves. It is an act which lies between two things: something that allows the practice: love and something that disallows it: ‘adab’ respect. Hence, the one who does it through overwhelming love is not criticized because this act is proven from the sahabah. Though, it is better for the general public to be precautious. Our scholars have explicitly stated that one should stand at least four feet away from the grave, so how would one kiss it!?” (Fatwa Ridhwiyah, 9:528)

786 as Bismillah

The objection that using 786 is a novelty. This is correct but so is the spread of printed matter and worldwide literacy. The Sunna way in this regard is to find ways to curb the risks of heedlessness and disrespect to sacred things in print. The use of 786 is one such way. A better one is to write the Arabic letter Ba’ to stand for the Basmala or to write: Bismihi Ta`ala = “In his Name, Most High.”

Deobandies against blind following of Saudi announcements

Deobandies make a stance against the blind following of saudi moonsighting decisions. Alhamdulillah, the wifaq-ul-ulama of the [UK] and many other senior ulama of the [UK] have agreed that following Saudi sighting is incorrect. A positive step has been taken to rectify the wrong.  

The CriteriaFatwa from Deoband –  another deobandi fatwaand another Contemporary deobandies standing up to deobandi elders who blindly follow saudi decisions/announcements  –  don’t follow saudi –   more deobandi stuff

One thing which the deobandies have overlooked is, one of the reasons why saudi decisions lost their credibility amongst sunnies in UK many many years ago was due to incidents such as that mentioned below, which have become very much prevalent with the saudi officials nowadays.

Dr. Salman Zafar Shaikh (of New Jersey, USA) reported from Riyadh, Saudi Arabia: About Official Saudi Report Ramadan 1427  I am currently in Riyadh. Yesterday – Wednesday, Dec 20 evening I went with the official Riyadh Moon sighting committee. Of course there was no chance of Hilal anywhere here and the 6 Official Hilal sighting committees of Saudi Arabia (near near Makkah, Riyadh, Qassim, Hail, Tabuk and Asir), each of which includes an Islamic Scholar, an Astronomer, a City council representative and volunteers) all reported negative sighting, as expected. Even the Moonset was before Sunset in Saudi and that is why even the Ummul Qura Calendar also put DhulHijja start for Friday, Dec. 22 and Eid ul Adha for Dec. 31, 2006.

But unfortunately, as is often the case, Saudi Justice Dept. has announced start of Dhul-Hijja incorrectly for Thursday, Dec 21; Hajj on Dec 29, and Eid-al-Adha on Dec 30. Also I met the Br. Hamza Al-Muzani (Saudi writer) who had written in Saudi “Al-Watan” Newspaper of Thursday, 10 DhulHijja 1425 AH in the article “Testimonies of the Impossible” (Click here) that last year Eid ul Adha witnesses were found to be over 80 years old. I found that after writing that article they put a false charge on the author of making fun of the beard of the Chief Justice and sentenced him to 4 months in prison and 200 lashes! Then Alhamdulillaah Saudi King Abdullah quashed the sentence! Also, this year the false start of Ramadan and Eidul Fitr was due the well known early witness: AlKhudayri from Huta Sudayr, Saudi Arabia! He is also one of the claimants this time for DhulHijja start.

Hadith of Adam tawassul through the Prophet (saw)

The prophet (saw) said: “When Adam committed the sin (mistake) he made, he raised his head toward the Throne and said: ‘I am asking You by the right of Muhammad (saw) to forgive me.’ Allah Most High revealed to him:

‘What is Muhammad? Who is Muhammad?’ 

He replied: ‘Glorified be Your Name! When You created me I raised my head toward Your Throne and saw there was written on it: LA ILAHA ILLALLAH MUHAMMADUN RASULULLAH. I knew that there was no one more magnificent in Your sight than him whose name You placed next to Your Name.

Allah Most High revealed to him: ‘O Adam, truly He is the last of the Prophets from your seed and his Community are the last of all Communities from your seed. Were it not for him, O Adam, I would not have created you.’”    read full here.
